George F. Daly & Company was established in 1972 by the late George Daly who sadly died in 1982.
Over the years we have gained solid experience in all areas of law, more particularly in the areas of litigation, probate, wills drafting, conveyancing and family law. We also attend at the forthnightly sittings of the Kinsale District Court, where in the appropriate circumstance are eligible to seek legal aid on behalf of a client, and in Cork District Court by arrangement.
Litigation is a broad term used when describing the process of resolving disputes. We always try to resolve disputes as efficiently as possible to achieve an effective result both in terms of cost and in terms of compensation. Not every dispute ends up in Court unless settlement cannot be reached. If it does have to be brought to Court we, like all solicitors, have access to the barristers who have expertise in the area. We have a specific area of specialisation in the following:

- Constitutional cases, particularly in relation to people with special needs
Probate - while this term refers to the extraction of a Grant of Probate in accordance with the persons Will after they have died, we are also expert in extracting a Grant of Administration to a person's estate when they have not left any Will, or when there have been particular difficulties in respect of the extraction of a Grant of Probate or Administration. While you do not have to instruct a solicitor to extract a Grant of Probate or Administration if you choose not to you may miss getting some important and vital advice that could save you time and money. This is particularly true in relation to tax matters.
The drafting of Wills - Once again you do not have to instruct a solicitor to draft a will, but there are a number of procedural matters to be followed in the signing of a will to ensure that it is valid. If you instruct George F. Daly & Co in relation to the drafting of your Will, you will get the most relevant advice for your circumstances. The different options open to you will be discussed in detail so you are fully informed as to the choices you make.
Conveyancing - this is the term used to describe the buying and selling of houses. If you are purchasing a house we will investigate the title to ensure that it is good and marketable and we will advise you if there are any difficulties. If you are obtaining a Mortgage, we will advise you of your liabilities to the Bank and ensure that you are fully aware of the rights of the Bank. If you are selling a property, having got your title documents we will draft the contract for sale and work to ensure that the sale date meets the target date that you have set. We can also undertake on your behalf and with your authority to pay off any loans out of the proceeds of sale.
Family law - When a person needs to instruct a solicitor they are usually in a very traumatised state. Family law clients are as different as the types of families from which they come and they need to engage a solicitor who will try to understand and grasp their concerns while at the same time giving them good solid practical advice. It is important when dealing with family matters especially if there are children involved to remember that the parties involved will have ongoing contact long after the legal side has been finalised. We can help you at this difficult time. We are strong advocates of the Collaborative Law system which in some cases can offer an alternative to the resolution of a dispute through the Courts. In the event that reconciliation is unachieveable we can advise you in relation to the drafting of a Separation Agreement. The other alternative is a Judicial Separation or a Divorce.

Enduring Powers of Attorney - this is a very important but little known mechanism whereby a person can prepare for their future in the event that they suffer from some disability that will not allow them to care for themselves.

Deed poll Applications-this is the procedure whereby a person can officially change their name.
Costs and fees - often it is impossible to give the actual fee in advance. We can however give an estimate of what we would expect our fees to be. The estimate is just that and can vary up or down depending on the issues that are raised during the course of any work done. We are more than happy to discuss this matter once we have received all pertinant details. We can run some litigation cases on a no win no fee basis, sometimes only requiring outlay to be paid.
